For too long this community’s rights were set aside and they were not able to marry in Pennsylvania. In 2014, the Commonwealth legalized same-sex marriage when a U.S. federal district court judge ruled that the ban on same-sex marriage was unconstitutional, a ban that was put in place in 1996. Until 2014, those who wished to get married had to do so in other states, like Vermont and Massachusetts. When they arrived back home in Pennsylvania, their marriage was not recognized. Additionally, they were locked in marriages and not permitted to divorce because of the same reason. In 2014, Pennsylvania became the 19th state to recognize the rights of this community. Gender Identity in Family Court

The attorneys at Ilkanoff & Silverstein recently attended a course titled Gender Identity in the Family Court. Family law deals with deeply personal issues that can be uniquely challenging for trans people, who are already extremely vulnerable in the legal system because of pervasive bias and misunderstanding. Reversing bad precedent, establishing favorable outcomes, and changing public attitudes regarding transgender people is especially critical in the area of family law because it presses so deeply on the most intimate of human relationships. This is what we discussed in this course. Our course focused on educating the other counsel in the case and the judge on these issues.
